When a Drunk Driver Causes a Car Accident

Driving while under the influence is something that is regulated in virtually every country round the world. In most places you are allowed to consume a small amount of alcohol and drive. However, it is important to be aware of the law in your state before you decide to have a drink.

Statistics show in 2015 that nearly one third of traffic related deaths were a result of alcohol impaired drivers.

There is no doubt that any accident can be devastating but those caused by drunk drivers are often worse simply because it seems so avoidable.

If you are in an accident and think the other driver might be under the influence, then it is important to follow these steps:

Contact the Police

The police do not need to attend every accident although they will attend if you are blocking the road, life is in danger or there is any suspicion that a law has been broken.

If you think the other driver is drunk call the police immediately. This will help you deal with the insurance companies afterwards and get your rightful compensation.

If you’re the drunk driver it is advisable to get in contact with your Sacramento Criminal Attorney immediately.

Photos

If you believe the other driver is drunk, then you should not approach them. Instead use your cell phone to take as many pictures of the scene and their actions as possible.

You should do this without putting yourself or anyone else in harm’s way. If the drunk driver uses mouthwash or any other potion, then record it.

Statement

You are reporting the drunk driver as a concerned citizen. When the police arrive you will need to make a statement. You should concern yourself only with the facts. No matter what the situation a personal vendetta against the drunk driver will not help you or your family.

Once you have finished with the police you should head home or somewhere where there are other people who can look after you. If you feel unwell it is advisable to visit the hospital.

It is important to be aware that most symptoms show approximately 24 hours after the accident, this is when you may need to take yourself to your personal doctor and have a proper check-up. If you are injured this will be important for your compensation claim.

The Drunk Driver

The drunk driver may be arrested. Their license will certainly be taken away although not actually suspended at that time.

They will need to get themselves a lawyer in order to be fairly represented through the courts. The fine and punishment they receive will be based upon the circumstances of the accident and whether anyone was injured or not.

No matter what the physical punishment you and the drunk driver will need to deal with the emotional side effects. It is advisable to seek counseling to make sure this does not develop into a bigger problem in the future.
